Swalwell: Military Can Act as ‘Check’ on Trump Amid Controversy

UPDATE: California Rep. Eric Swalwell stated on October 23, 2023, that military members have expressed their role as a potential “check” on President Donald Trump‘s authority. During an appearance on Don Lemon‘s show, Swalwell addressed the fallout from a video featuring six Democratic lawmakers urging service members to “refuse illegal orders” from Trump.

This urgent claim follows the Department of War‘s announcement of a formal review into allegations of misconduct against Arizona Senator Mark Kelly, a retired Navy captain, related to his participation in the contentious video. Swalwell suggested that the Trump administration’s reaction to Kelly’s message indicates deeper issues surrounding military compliance and constitutional loyalty.

Swalwell highlighted the sentiment shared by service members, saying, “While Congress is not a check on the president anymore, and the judiciary at the Supreme Court is hardly a check, military members have told me, ‘We can be a check.’” He emphasized that many in the military are committed to upholding their oath to the Constitution, regardless of Trump’s commands.

The video, which has sparked significant controversy, features notable figures including Senator Elissa Slotkin and Representatives Chris Deluzio, Maggie Goodlander, Chrissy Houlahan, and Jason Crow. They collectively stated, “Our laws are clear. You can refuse illegal orders.” This statement has drawn sharp criticism from retired military officials who label the lawmakers’ messaging as “irresponsible.”

Swalwell further argued that the administration’s pushback against Kelly indicates an underlying willingness to issue unlawful orders. “If you don’t intend to carry out unlawful orders, why do you care that somebody would say that?” he challenged.

Adding to the urgency, fellow Democratic Senator Ruben Gallego warned on CNN that military members involved in targeting senators could face serious consequences. “Donald Trump is going to be gone in a couple of years,” Gallego stated firmly. “There will be consequences, without a doubt.”
