Genesis HealthCare, a prominent provider of health care services in the United States, filed for Chapter 11 bankruptcy on July 9, 2023. Despite this significant announcement, the company has assured that its nursing facilities across New Hampshire will remain unaffected. Genesis operates nearly 200 centers across 17 states, including 15 nursing homes and two supported residential care facilities in New Hampshire.
The bankruptcy filing took place in the Northern District of Texas, where Genesis reported estimated liabilities between $1 billion and $10 billion. The company highlighted over $780 million in unsecured claims owed to its 30 largest creditors. Among these obligations, Genesis noted a real estate loan of $324 million and $103 million in deferred payroll taxes. The financial challenges faced by Genesis have been exacerbated by ongoing issues related to the COVID-19 pandemic, which reportedly led to losses of approximately $60 million in the third quarter of 2020.
Future Operations and Financial Restructuring
In response to the bankruptcy, Genesis HealthCare emphasized its commitment to maintaining normal operations. A press release from the company stated that it has secured a commitment of $30 million in debtor-in-possession financing, pending court approval. This funding, combined with cash reserves and ongoing operational cash flow, aims to support the business during the restructuring process.
The company made provisions to ensure that staff will retain their positions, pay, and benefits. In an email, a spokesperson affirmed that vendor agreements would remain intact and that there would be no expected impact on patient care. “We are notifying all appropriate regulators, officials, partners, and individuals who will be affected by this filing,” the spokesperson said.
Brendan Williams, the president and CEO of the New Hampshire Health Care Association, expressed confidence in Genesis’s ability to navigate this challenging period. He stated, “I think when they come out on the other side of this, they will be stronger than ever.” Williams noted that Genesis had already taken steps to improve its financial situation by selling facilities that were no longer viable.
Importance of Nursing Facilities in New Hampshire
As the second oldest state in the U.S. by median age, with an average of 43.4 years, New Hampshire relies heavily on its nursing home facilities. Williams emphasized the significance of maintaining services for the aging population, stating, “Nursing home care is a very difficult business, and Genesis accounts for a significant portion of the private nursing homes in our state.”
